These rules supplement the Terms of Use and apply to every advertiser. You accept them by publishing your first listing or by establishing a data connection with Propertico.
If you are an advertiser using the service in the course of your business, these rules also constitute the terms and conditions required by Regulation (EU) 2019/1150 on promoting fairness and transparency for business users of online intermediation services.
01 Who may advertise
Listings on Propertico may be published by:
- Real-estate agencies — registered in Croatia or another Member State, advertising properties for which they hold a brokerage agreement or other authority.
- Agents — through their agency, as the named contact person on that agency's listings.
- Private advertisers — natural persons advertising their own property, without brokerage and without charging commission.
A private advertiser must not present itself as an agency, nor may an agency publish listings under a private advertiser account. If we find that a business is being run through a private account, we may remove the listings and move the account to the appropriate business plan.
Publishing requires a user account. The details in the account must be accurate and current, and for legal persons must match the entries in the court or trades register.
02 Accuracy of information and authority to advertise
By publishing each listing you expressly warrant that:
- you hold the right and authority to advertise the property in question — as owner, as a broker under a valid brokerage agreement, or on another valid basis;
- all information in the listing is accurate, complete and current — in particular the price, floor area, number of rooms, floor, year of construction, location and legal status of the property;
- the property genuinely exists and really is available for sale or letting on the terms published;
- the price published is the actual asking price and is not used to attract enquiries about other properties;
- you hold all necessary rights in the photographs, videos, floor plans and texts you publish;
- publication breaches no law, no third-party right and no obligation you owe to your principals.
You alone are responsible for the accuracy of listing content. Propertico does not verify ownership, land-registry status or your authority to advertise.
You must update or remove a listing without delay as soon as the information changes, and in any event once the property has been sold, let or withdrawn from the market.
03 Listing content rules
So that listings stay useful and comparable, the following rules apply:
- one listing covers one property; publishing the same property more than once for greater visibility is not permitted;
- the title and description must relate to the property advertised and must not contain keyword stuffing, the names of other localities, or content aimed solely at search engines;
- the property must be placed in the correct category, sale type and location;
- contact details, external links and promotional content do not belong in the title or the description, but in the fields provided for them;
- photographs must show the property advertised; using photographs of a different property, unlabelled illustrations, or images watermarked by another listings site is not permitted;
- the description must be in the language of the listing and intelligible to the reader.
04 Prohibited listings
You must not publish listings that:
- are false or misleading, or relate to a property that does not exist;
- serve to harvest contacts or to sell services, credit or financial products rather than to advertise a property;
- contain discriminatory conditions, for example exclusion on grounds of nationality, religion, sex, disability, age or family status, except where the distinction is expressly permitted by law;
- infringe copyright, trade marks or the personality rights of third parties;
- contain the personal data of third parties without their consent, including photographs of identifiable individuals;
- relate to property whose disposal is prohibited or restricted, without disclosing that restriction;
- contain abusive, violent or otherwise unlawful content.
05 Photographs and licence
By publishing photographs, videos, floor plans and texts you retain all your rights, but grant Propertico a non-exclusive, royalty-free and territorially unlimited licence to display, store, technically adapt (resize, reformat and compress), translate and use those materials in promoting the platform and the listing itself, including publication on connected channels, social media and data feeds to partner services.
The licence lasts while the listing is published and ends within a reasonable time after its removal, except for copies we must retain as evidence or under applicable law.
You warrant that you hold all rights necessary to grant this licence — in particular where photographs were taken by an external photographer or imported from a third-party system. If a third party brings a claim for infringement in respect of material you published, you must indemnify us for the resulting loss and costs.
06 Energy performance certificate
When advertising a building or an independent part of one for sale or letting, construction and energy-efficiency legislation requires the energy rating from the energy performance certificate to be stated in the advertisement.
Propertico provides a field for the energy rating and displays it on the listing page. Obtaining the certificate and the accuracy of the rating stated are the advertiser's responsibility. We recommend entering the energy rating in every listing to which that obligation applies.
07 Review, rejection and removal of listings
Listings entered through the user portal are reviewed before publication. This is a basic formal check — we look at completeness, intelligibility, categorisation and obviously inappropriate content. We do not verify ownership, authority to advertise, or the accuracy of the information.
Any change to a published listing sends it back for review. The listing is not publicly visible until the review is complete.
We may reject, remove, temporarily disable or restrict the visibility of a listing where it breaches these rules, the Terms of Use or the law, or where we receive a well-founded report.
Statement of reasons
We notify you by email when a listing is rejected, removed or restricted, with a statement of reasons setting out the ground for the decision, its factual basis, and how it can be challenged. You may challenge the decision by replying to that notice; we will reconsider it without delay and tell you the outcome.
08 Restriction, suspension and termination of accounts
We may restrict, suspend or permanently terminate the provision of the service to an advertiser in the following cases:
- repeated or serious breach of these rules or of the Terms of Use;
- publication of false or misleading listings;
- failure to pay sums due after the period stated in a reminder has expired;
- conduct contrary to the law or to an order of a competent authority;
- misuse of the platform, its interfaces or other users' data;
- reasonable suspicion of fraud or of unauthorised use of another person's identity.
Notice and time limits
Before restricting or suspending the service we give you a statement of reasons, at the latest at the moment the measure takes effect.
Permanent termination of the service is notified at least 30 days in advance, with a statement of reasons. A shorter period, or no notice, is possible exceptionally — where a law or an order of a competent authority requires it, where there is a legitimate reason connected with security or the prevention of fraud, or where the advertiser repeatedly breaches these rules.
Within the notice period you may ask for clarification and put your case. If we withdraw the measure, we restore the listings to their previous state without delay.
After the service ends we allow you a reasonable period to retrieve your data and content before it is deleted.
09 Ranking and paid featuring
This section sets out the main parameters determining how listings are ranked, and the reasons for their relative importance.
Main parameters
- Date of publication — the default order in search results and on archive pages is newest first. We put newer listings first because they are generally the most accurate and the most likely still to be available.
- The visitor's own choice — visitors can change the order and sort by price or by floor area, ascending or descending. That choice takes precedence over the default order.
- Match with filters — only listings matching the selected filters are shown (location, property type, sale type, price range and so on). Filters determine which listings appear, not the order between them.
- Similarity — the related listings on an individual property page are those similar in location, type and price.
We apply no hidden relevance scores, no personalisation and no visitor profiling when determining order. Ranking does not depend on which plan an advertiser uses or how much it pays, other than through the paid featuring described below.
Paid featuring
Ranking can be bought directly. Featuring a listing places it in one of a limited number of slots at the top of a list, ahead of the listings ordered by the default ranking.
The number of slots is limited — three by default, six at most per list. Featuring applies in search results and on archive pages, on the home page, on city pages, and among related listings.
Where more listings are featured than there are slots, the slots are allocated by a refreshed random draw. No advertiser thereby acquires a permanent slot, and neither the duration nor the price of featuring affects the likelihood of being shown during the featured period.
Featuring affects only where a listing is displayed. It does not change the listing's content, does not remove other listings from the results, and does not constitute any check, recommendation or rating of a property by Propertico.
Featuring is agreed and charged separately from a subscription. Terms and prices are available on request.
10 Differentiated treatment
Propertico publishes no property listings of its own and has no affiliated advertisers to favour. All listings are subject to the same display rules.
There are two differences in treatment, which we set out expressly here:
- Paid featuring — advertisers who pay for featuring receive a better display position, as described in the previous section. Featuring is available to all advertisers on the same terms.
- Listings from data feeds — listings imported from agency systems are not individually reviewed before publication and are not subject to expiry, because they are refreshed automatically from source. Manually entered listings are reviewed and do expire. That difference follows from the technical nature of the source, not from favouring any particular advertiser.
The permitted number of listings and the additional features available differ by plan, as published in the pricing. This does not affect ranking.
11 Access to data
As an advertiser, the user portal gives you access to the following data about your listings:
- Enquiries — the full enquiries received on your listings, including the sender's name, email address, telephone number and message. You process that data as an independent controller and must comply with data-protection law.
- View statistics — the daily number of views of each listing, collected through our web analytics tooling and available for the period the listing was published.
- Visitor activity — aggregate, anonymous indicators such as the number of contact-reveal clicks and the number of times a listing was saved to favourites. This data contains no visitor identity.
- Listing history — a record of status changes to your listings (publication, modification, expiry, removal).
You can export enquiry and statistics data or request it from us at [email protected]. We do not share one advertiser's listing data with another advertiser.
We may use aggregated and anonymised market data for analytics, reporting and promoting the platform, in a form that does not allow any advertiser or visitor to be identified.
12 Automatic listing import (data feeds)
Instead of entering listings manually, agencies can set up a technical connection through which Propertico imports listings automatically from their system. We establish the connection only on the agency's express instruction and using credentials the agency supplies; we store those credentials in encrypted form.
Listings imported this way are edited solely in the source system — they cannot be changed in the user portal, and they are refreshed on the agreed schedule. Removing a listing at source removes it from Propertico too.
Where the agency enables it, we also import contact-person details alongside the listings (an agent's first name, surname, email address, telephone number and photograph) and display them on the listing. The agency warrants that it has a valid basis for this and has informed its agents. Disabling the option deletes the imported agent data.
The agency is responsible for the content of imported listings in exactly the same way as for manually entered ones.
13 Listing duration and renewal
Manually entered listings are published for a fixed period. Before expiry we send an email reminder with a one-click renewal link; you can also renew from the user portal. A listing that is not renewed stops being publicly visible but is kept in the portal and can be republished.
Listings imported from data feeds are not subject to expiry, because they are refreshed automatically from the source system.
The publication period and reminder timings are published in the user portal and may be changed on notice in accordance with the section on changes.
14 Advertiser complaints
You can bring a complaint about a decision to reject, remove or restrict a listing, about restriction or termination of an account, about a charge, or about the application of these rules, to [email protected].
We consider complaints without delay, taking account of all the circumstances raised, and give you a reasoned outcome in writing within a reasonable time.
If we cannot settle a dispute amicably, we are willing to take part in mediation at one of the mediation centres in Croatia. Taking part in mediation does not affect the right to bring court proceedings.
Propertico is a small enterprise for the purposes of Regulation (EU) 2019/1150 and is therefore not required to operate an internal complaint-handling system or to name mediators under Articles 11 and 12 of that Regulation. We nevertheless consider advertiser complaints as described in this section.
15 Changes to these rules
We may amend these rules to comply with the law, to reflect changes in our services, or to improve the platform.
We notify advertisers of changes by email at least 15 days before they take effect. Within that period you may terminate the contract free of charge; continuing to publish listings after the changes take effect constitutes acceptance.
The notice period does not apply where a change is required to comply with a legal obligation, to address an immediate security threat or to prevent fraud, nor where the change introduces a new optional feature.
